SC Collegium doing what it should, fast

  1.  The Supreme Court's Collegium has recommended nine names in one shot, for appointment to the SC, which if accepted by the govt. (and appointed by the President), will almost fill all vacancies in the SC
  2. Not all Chief Justices (CJI) succeeded in getting judges appointed to the SC, and CJI TS Thakur cried at a function (2016) in PM's presence out of anguish on this matter
  3. Present CJI NV Ramana seems to have made a big move, in a short time span
  4. Selection of SC judges is a tough job, and ever since the Collegium was created by the SC (shocking the political establishment), it has to ensure extra care in not making mistakes in selection (be transparent, take right people)
  5. Since the Collegium has all senior-most judges of the SC, all with decades of sharp experience, getting consensus is never easy; that the CJI could get consensus on 9 names in first meeting itself, is remarkable!
  6. That three women too were recommended is a very positive move, and this may not happen anytime soon in the future
  7. Article 142(1) is about 'complete justice' in any matter (by the Supreme Court), and selection of judges must be in keeping with that criterion
  8. The SC had listed the parameters for candidate selection in a 1993 verdict in the "SC AOR Association and Another vs Union of India (1993)", the most crucial being merit of the candidate
  9. And what is merit? The ability of the judge to deliver complete justice
  10. The big issue here is of India's diversity, and the need to accurately respect it while selecting people; the SC accepts that it has to ensure representation of all communities, religions, genders, regions and castes
  11. Since India is the only country where judges appoint judges (in SC), hence transparency of norms is a must; a 2019 Bench of the SC spoke of it in clear terms (and of the public's need to know the reasons for selection)
  12. So what are the norms? It's a blend of (i) merit, (ii) seniority, (iii) interests of the marginalised and deprived sections (women, religions, regions, castes), etc.
  13. Were these followed in 2021? Three are women, one is from S.C., one is from OBC, and nine are from different states (Kerala, TN, Karnataka, AP, Maharashtra, MP, UP, Delhi, Gujarat)
  14. All have a track record of protecting citizens' liberty, including pulling up the government in the wake of Covid-19 crisis
  15. There is some controversy over the "Rule of Seniority" (actually a non-existing rule), which had been responsible for the delays in appointment in previous years
  16. The 22 month logjam was broken by the CJI and even is some are complaining, they aren't complaining of the quality of those selected
  17. In parallel, the Collegium cleared 7 names from district judges for the Telangana High Court too - speed is of essence with CJI Ramana
  18. Government must quickly issue the appointment orders, and take the mission of justice forward
